    Terms of Service

    1. Acceptance of Terms

    These Terms of Service ("Terms") govern your access to and use of the Pool Pros website and related services (collectively, the "Platform") operated by Pool Pros ("we," "us," or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

    2. Description of Service

    Pool Pros is an online directory and marketplace that connects homeowners with pool service professionals. We provide a platform for homeowners to find, compare, and request quotes from pool companies. We do not directly provide pool services, and we do not employ, endorse, or guarantee any service professional listed on the Platform.

    3. Eligibility

    You must be at least 18 years old and capable of forming a binding contract to use the Platform. By using the Platform, you represent that you meet these requirements.

    4. User Accounts

    • You are responsible for maintaining the confidentiality of your account credentials.
    • You agree to provide accurate, current, and complete information during registration and to keep it updated.
    • You are responsible for all activities that occur under your account.
    • You must notify us immediately of any unauthorized use of your account.
    • We reserve the right to suspend or terminate accounts that violate these Terms.

    5. Homeowner Responsibilities

    • You agree to provide accurate information when requesting quotes, including your location, service needs, and contact details.
    • You understand that by submitting a quote request, your information will be shared with matched service professionals.
    • You are solely responsible for evaluating, selecting, and contracting with any service professional.
    • Pool Pros is not a party to any agreement between you and a service professional.

    6. Service Professional Responsibilities

    • Professionals must provide accurate business information, including licensing, insurance, and service area data.
    • Professionals agree to respond to leads promptly and professionally.
    • Professionals are solely responsible for the quality, safety, and legality of services they provide.
    • Professionals must maintain all required licenses, permits, and insurance for their jurisdiction.
    • Misrepresentation of credentials, reviews, or services may result in immediate removal from the Platform.

    7. Prohibited Conduct

    You agree not to:

    • Use the Platform for any unlawful purpose or in violation of any applicable laws.
    • Submit false, misleading, or fraudulent information.
    • Post fake reviews, manipulate ratings, or engage in deceptive practices.
    • Interfere with or disrupt the Platform's infrastructure or security features.
    • Scrape, harvest, or collect data from the Platform without written authorization.
    • Use the Platform to send unsolicited commercial messages (spam).
    • Impersonate another person or entity.

    8. Intellectual Property

    All content on the Platform-including text, graphics, logos, icons, images, software, and compilations-is the property of Pool Pros or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

    9. User-Generated Content

    By submitting reviews, feedback, or other content to the Platform, you grant Pool Pros a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with the Platform. You represent that you own or have the right to submit such content and that it does not violate any third-party rights.

    10. Fees & Payments

    Certain features of the Platform may be subject to fees. All fees are stated at the time of purchase and are non-refundable unless otherwise specified. We reserve the right to change pricing with reasonable notice. Failure to pay may result in suspension of services.

    11. Disclaimer of Warranties

    THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE THE QUALITY, ACCURACY, OR RELIABILITY OF ANY SERVICE PROFESSIONAL LISTED ON THE PLATFORM.

    12. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOL PROS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, ANY SERVICES PERFORMED BY PROFESSIONALS FOUND THROUGH THE PLATFORM, OR ANY CONDUCT OF THIRD PARTIES ON THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

    13. Indemnification

    You agree to indemnify, defend, and hold harmless Pool Pros and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

    14. Dispute Resolution

    Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the state where Pool Pros is headquartered. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

    15. Termination

    We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.

    16. Governing Law

    These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles.

    17. Changes to These Terms

    We may revise these Terms at any time by posting the updated version on this page with a revised "Effective Date." Material changes will be communicated through the Platform or via email. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.

    18. Severability

    If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
